These Terms of Service (the “Terms”) govern your access to and use of the website at latecheckout.travel (the “Site”) and the services described on it (the “Services”), which are provided by Late Checkout (“Late Checkout,” “we,” “us” or “our”).
By accessing the Site, submitting an enquiry, purchasing a Service or asking us to arrange travel on your behalf, you confirm that you are at least eighteen years of age, that you have authority to bind any person on whose behalf you act, and that you accept these Terms and our Privacy Policy. If you do not accept them, you must not use the Site or the Services.
Where you book travel on behalf of others, you are responsible for ensuring that each traveller is aware of and accepts these Terms and the terms of every supplier.
Late Checkout is an independent travel advisory. We act as an intermediary between you and the hotels, resorts, residences, operators and other third parties who provide travel and accommodation (“Suppliers”). We do not own, operate or control any Supplier, and we are not a party to the contract between you and a Supplier.
Reservations are made through our host agency, Fora Travel, Inc. (“Fora”), an accredited travel agency. A reservation made through Fora is subject to Fora’s terms of service and to the Supplier’s terms, both of which are presented before you confirm and which prevail over these Terms in respect of that reservation.
We may decline, limit or discontinue any Service, or any request, at our discretion and without obligation to give reasons. Descriptions of properties and benefits on the Site are provided for general information, reflect our understanding at the time of writing, and do not form part of any contract.
Advisory and reservation services are provided to you without charge. We are compensated by Suppliers, through Fora, by way of commission on reservations made through us. Where an introduction to a residence results in a transaction, we may receive a referral fee or commission from the developer, owner, agent or operator. Such compensation does not increase the price you pay and does not affect the independence of our advice.
Any fee payable to us directly, including the Review fee and Membership fees, is stated before you pay and is payable in advance in the currency shown. Fees are exclusive of any taxes or charges that may apply in your jurisdiction, which are your responsibility.
In relation to residences, we provide introductions only. We are not a real estate broker, agent or adviser, and we do not act for you or for the counterparty in any purchase, lease or investment. Any transaction is concluded directly between you and the developer, owner, agent or operator, on their terms and documentation.
Information about residences, including pricing, availability, specifications, yields and completion dates, is supplied by third parties and provided without verification. You are responsible for obtaining independent legal, financial and tax advice before entering into any transaction.

Costs arising from inaccurate information, invalid documentation or a failure to comply with Supplier terms are your responsibility.
We strongly recommend that you obtain comprehensive travel insurance covering cancellation, curtailment, medical expenses, repatriation and personal property before paying any deposit. Travel involves inherent risks, including those arising from weather, natural events, public health measures, political conditions, Supplier insolvency and changes to entry requirements. You accept these risks, and we are not responsible for the consequences of your decision to travel or not to travel.
The Site and the Services are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the Site will be uninterrupted or error-free, that any Supplier will perform, or that any recommendation will meet your expectations. Opinions expressed on the Site are our own and are not guarantees of any kind.
To the fullest extent permitted by law, Late Checkout, its principals, employees, contractors and affiliates shall not be liable for any indirect, incidental, consequential, special or punitive damages, or for any loss of profit, enjoyment, data or goodwill, arising out of or in connection with the Site, the Services, any reservation or any act or omission of a Supplier, however caused and under any theory of liability.
Our total aggregate liability to you in connection with the Services shall not exceed the fees you have paid directly to us in the twelve months preceding the event giving rise to the claim. Where no fee has been paid to us, our liability shall not exceed one hundred US dollars.
Nothing in these Terms excludes or limits liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be excluded or limited by law.
You agree to indemnify and hold harmless Late Checkout and its principals, employees, contractors and affiliates from and against any claim, loss, liability, damage, cost or expense, including reasonable legal fees, arising out of your breach of these Terms, your breach of any Supplier’s terms, your violation of any law or the rights of a third party, or the acts or omissions of any person travelling under a reservation made at your request.
We shall not be liable for any failure or delay in performance caused by events beyond our reasonable control, including natural disasters, epidemics, acts of government, war, terrorism, civil unrest, strikes, failures of transport or communications, or the insolvency or default of any Supplier.
The Site and its contents, including text, photography, design, compilations and software, are owned by or licensed to Late Checkout and are protected by copyright and other intellectual property laws. You may view and print pages for your personal, non-commercial use. You may not otherwise reproduce, distribute, modify, publicly display or create derivative works from any part of the Site, nor use any automated means to extract its contents, without our prior written consent. Supplier names and marks are the property of their respective owners and are used for identification only; their appearance does not imply endorsement.
The Site contains links to, and may direct you to, websites and services operated by third parties, including booking, payment, scheduling and messaging services. These are governed by their own terms and privacy policies. We do not control them and accept no responsibility for their content, availability or practices.
We treat your identity, travel plans and preferences as confidential and disclose them only as necessary to provide the Services or as required by law. Our collection and use of personal information is described in our Privacy Policy, which forms part of these Terms.
We may suspend or terminate your access to the Site or the Services, or decline to act on any request, at any time and for any reason, including a breach of these Terms. Sections 5 and 10 to 19 survive any termination.
These Terms, and any dispute or claim arising out of or in connection with them or the Services, are governed by the laws of the jurisdiction in which Late Checkout is established, without regard to conflict-of-law principles. The courts of that jurisdiction have exclusive jurisdiction, and you submit to it.
Before commencing proceedings, you agree to notify us in writing of any claim and to attempt in good faith to resolve it with us for a period of thirty days. Any claim must be brought within one year of the event giving rise to it, after which it is barred to the extent the law allows.
Nothing in this Section deprives you of any mandatory protection afforded by the consumer law of the country in which you reside.
